แถลงการณ์เรื่องการคุกคามสิทธิเสรีภาพสื่อออนไลน์ สืบเนื่องจากกรณีพนักงานสอบสวนกองปราบปรามได้เข้าจับกุมนางสาวจีรนุช เปรมชัยพร ผู้อำนวยการเว็บไซต์หนังสือพิมพ์ออนไลน์ประชาไท (http://www.prachatai.com) เมื่อเวลาประมาณ 14.30 น. ของวันศุกร์ที่ 6 มีนาคม พ.ศ. 2552 และได้มีการสืบปากคำพร้อมทำสำเนาข้อมูลในฮาร์ดดิสก์คอมพิวเตอร์ส่วนตัวของนางสาวจีรนุช และแจ้งข้อกล่าวหาว่าได้ทำการสนับสนุนผู้ถูกดำเนินคดีในข้อหา เป็นผู้ให้บริการจงใจสนับสนุนหรือยินยอมให้มีการกระทำผิด นำเข้าสู่ระบบคอมพิวเตอร์ ซึ่งข้อมูลคอมพิวเตอร์ปลอมไม่ว่าทั้งหมดหรือบางส่วน หรือข้อมูลคอมพิวเตอร์อันเป็นเท็จ ซึ่งอาจเกิดความเสียหายแก่ผู้อื่นหรือประชาชน นำเข้าสู่ระบบคอมพิวเตอร์ ข้อมูลอันเป็นเท็จ โดยที่จะเกิดความเสียหายต่อความมั่นคงประเทศ และเผยแพร่ หรือส่งต่อ ซึ่งข้อมูลคอมพิวเตอร์โดยรู้อยู่แล้วว่าเป็นข้อมูลคอมพิวเตอร์ ตาม พ.ร.บ.คอมพิวเตอร์ พ.ศ.2550 มาตรา 14 (1) (3) (5) และ15

STOP ONLINE MEDIA INTIMIDATION Reference is made to the arrest of Ms. Chiranuch Premchaiporn, web manager of online newspaper Prachatai (http://www.prachatai.com) by the police at approximately 2.30 pm on Friday March 6, 2009, after which the police investigated her, copied hard disk in her personal notebook computer, and charged her with the violation of Sections 14(1), 14(3), 14(5), and (15) of the Computer Crime Act, which pertain to crimes which “involve import to a computer system of forged computer data, either in whole or in part, or false computer data, in a manner that is likely to cause damage to that third party or the public; that involves import to a computer system of any computer data related with an offence against the Kingdom's security under the Criminal Code; that involves the dissemination or forwarding of computer data already known to be computer data [which are illegal]” and “any service provider intentionally supporting or consenting to an offence …within a computer system under their control shall be subject to the same penalty as that imposed upon a person committing an offence…”

Crime Suppression police yesterday raided the office of non-profit online newspaper Prachatai, accusing its Web director of violating the Computer Act by posting lese-majeste comments. Web director Chiranuch Premchaiporn was arrested on a charge of committing a computer crime, because she allowed the offending comments to be posted on Prachatai's Web board. The website said Chiranuch denied the allegation and would agree to be interrogated only in front of her lawyer.

Police in Thailand have arrested the editor of a leading political website, on charges of carrying content that threatens national security. The Bangkok-based Prachatai website is well-known for carrying content that Thai newspapers will not publish. The charge carries a maximum five-year jail sentence.

BANGKOK (AP) — Police detained a webmaster at one of Thailand's top online newspapers on Friday after they said they found a reader's comments offensive to the Thai monarchy posted on the site. The raid on the Prachatai offices comes amid a crackdown on Web sites that authorities say are critical of the monarchy and a flurry of prosecutions for "lese majeste" — a law that prohibits insulting the country's revered king.
