Today (April 3, 2009), the criminal court sentenced Mr. Suwicha Thakor to 10 years in jail for posting pictures and comments on the Internet that were deemed insulting to the country’s monarchy.

Mr Thakor, a 34-year-old engineer, is a father of three children. He was arrested in Nakhon Phanom on January 14, 2009 for publicizing lèse majesté content on various websites.
In fact, from both Section 112 and the computer-related crime act, the court sentenced him to 20 years in jail, but as he has confessed the charge is reduced to 10 years.

คุณสุวิชาวัย 34 ปี ทำงานตำแหน่งวิศวกรเครื่องจักร ของบริษัทขุดเจาะน้ำมันแห่งหนึ่ง ถูกเจ้าหน้าที่ตำรวจจับกุมตัวเมื่อวันที่ 14 ม.ค. 2552 ที่จังหวัดนครพนม ด้วยข้อหาเผยแพร่ข้อมูลรูปภาพ ซึ่งเป็นการกระทำดูหมิ่นองค์พระมหากษัตริย์และองค์รัชทายาท อัยการขอให้ลงโทษตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2550 มาตรา 8, 9 ประมวลกฎหมายอาญา มาตรา 33, 83,91 และ 112 และพระราชบัญญัติการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 มาตรา 3, 14 และ 16
ศาลได้ตัดสินว่าคุณสุวิชามีความผิดตามรัฐธรรมนูญแห่งราชอาณาจักรไทย พ.ศ. 2550 มาตรา 8, 9 ประมวลกฎหมายอาญา มาตรา 33(1), 83,91 และ 112 และพระราชบัญญัติการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 มาตรา 14(2) และ 16(1) เนื่องจากเป็นความผิดหลายบท ให้ลงโทษตามมาตราที่มีโทษสูงสุด และความที่จำเลยกระทำความผิด 2 กระทง ให้ตัดสินให้ลงโทษ กระทงละ 10 ปี รวม 20 ปี แต่จำเลยให้การรับสารภาพ จึงลดโทษให้กระทงละ 5 ปี คงเหลือโทษจำคุก 10 ปี ไม่รอลงอาญา และให้ริบของกลาง
